Can a company charge you a 3% fee for accepting mastercard?

I know they are allowed to have a min. amount for accepting the mastercard, but if they accept mastercard are they allowed to charge a 3% fee above the amount just for accepting mastercard? I read somewhere that it is against visa and mastercard policy to do this, but I’m not sure on the law.
